Yes. In your own motor vehicle. No smoking. This is really going too far.

Now all we need is a ban on smoking in any public place and its all good. Ive always wondered why so many councils ban drinking on the street, but your allowed to smoke. Ive never seen a drunk guy swallow half a beer, then chunder it up in your face. Smokers do it 70 times a day and think its normal. Fuck smokers :clap:

I've never seen a guy smoke 10 cigarettes and get violent in peoples faces and cause a public nuisance.

But thats the reason why they ban drinking on the street. To control people like that. Also why they banned drinking at the cricket up here.

No idea. Maybe its the same reason as cellphones, but you can't get a headset for a smoke :P

That is ridiculous. They can't stop someone from smoking in their own car, its their own property. They might as well say you can't smoke in your own home, either.
If that argument worked, you wouldnt need council approval to build on your own land and crap like that.
Hell, youd be able to smoke pot and shoot up in your home.

Um, check the laws. There is no law against USING drugs, the laws are written in such a way that possession and distribution is illegal, not use.

Yes. You can use them as long as it doesn't involve paraphenalia, possession of them, and you found them. :D
Inhaling, swallowing, injecting, sniffing, go for it. No law against that. :D

Actually if you "found" them it'd still be illegal as:
It shall be unlawful for any person knowingly or intentionally to possess a controlled substance unless such substance was obtained directly, or pursuant to a valid prescription or order, from a practitioner, while acting in the course of his professional practice, or except as otherwise authorized by this subchapter or subchapter II of this chapter.
So yes, you can only legally have controlled substances in your possession if they're acquired through official means for agreed upon purposes.

It is NOT about control or the majority limiting the rights of the minority. It's about PUBLIC SAFETY, which the state is well within its rights to legislate.
Bans on smoking tobacco in cars is excessive. I don't care if you smoke in your home or car. They are your lungs. You can poison them all you want.

No you can't. Actively using a drug requires that you possess it. You exert control and possession over the drug through your actions.
I'd love to see the judge laugh your ass into jail if you tried to make that argument in court though.

Hence my confusion. I suppose it's somewhat like the 'legal to upload copyright music but not to download it' thing. The Letter of the Law is confusing...
^That's not tehnically true either because RIAA has been going after seeders a LOT lately. There's some loophole about distribution. This is also what allows proescution of people who obtain and distribute pre-release copies of movies, etc.
You can legally upload purchased media to your PC and you can legally allow P2P connections, but once you start distributing the media, you violate the law.

The problem is, this is about tobacco. It isn't about alcohol or meth or cocaine. Tobacco doesn't lower ones ability to operate a car like real "drugs" do. No amount of derailing this thread into a discussion on drunken driving or driving under the influence of a controlled substance will make tobacco do that.
There isn't a PUBLIC safety issue here. This is a choice issue. I choose to smoke and the nanny state should leave me alone.

Yes, but that is the actions of others, not you. They posess the drug. That's why getting a contact high isn't illegal. Driving with a contact high is, however.

I was actually discussing this with my girlfriend last night (she's Australian). It was somewhat funny because after this, she showed me a Coke ad that was banned. Let me see if I can find it. Here we go: http://www.thezeromovement.com/
Go to that website and watch the ad. That ad was banned. Why? Supposedly it encouraged unsafe driving practices.
So between this, that ad and the Marc Ecko game that was banned a little while back I asked my girlfriend an honest question: "Hun, why are your lawmakers so anal?"
I now pose that question to the Aussies on the board. I'm honestly interested in why these guys seem so ban-happy.

The US isnt the whole world! REALLY! Other countries have DIFFERENT laws. REALLY! Different states or provinces within those other countries also have varying laws.
Use of illicit drugs is a specific crime against the laws of Victoria, Australia. Ive worked in criminal records and seen people charged for use BUT NOT possession. (No, I dont know how they managed to use it without possessing it. I think its just what the cops use when they want to be nice).
